Joining the 2024 NHACE Agreement
The NHACE Agreement has been signed off by the Fair Work Commission, with the requirement that some undertakings be made by NHVic on behalf of employers. The agreement includes a list of employers who have been accepted by the Fair Work decision and some additional minor changes.

For employers who want to adopt the 2024 NHACE agreement but did not enter into the Fair Work process, you can adopt the agreement as a matter of policy for your employees.

This is because the terms and conditions in the agreement are above award and compliant with National Employment Standards.

You will need to:
-
Minute the decision at a Committee meeting. This can simply be a motion that "XX Neighbourhood House moves to adopt the NHACE Agreement 2024 and its terms and conditions for all employees."
-
Communicate the decision to employees and make the new agreement available to them (providing a link to the document is fine).
-
Reflect the change in letters of offer and employment contracts, eg:
“The terms and conditions of the [delete as necessary] SCHADS Award / Children’s Services Award / ESPE Award does not form part of this contract but will apply except where superior terms and conditions exist in the NHACE 2024 Agreement which forms part of this contract of employment.  The National Employment Standards (NES) will apply to this contract but does not form part of the contract of employment."
For any further questions about adopting the NHACE, please contact NHACE@nhvic.org.au.

If you are a childcare provider who will be linking this agreement to an IFA, please contact NHACE@nhvic.org.au.
